In light of this uncertainty and irreparable harm, Judge McConnell just further ordered agencies to "immediately end any federal funding pause...[and] immediately restore withheld funds." Communities across the country are eagerly waiting for agencies to comply.

Administrator Regan created the EJ Office to bring together disparate functions across EPA and ensure the Agency was working effectively to help ALL communities facing disproportionate adverse health and environmental impacts. Most, if not all, staff are now on Admin Leave and their future is TBD.

Administrator Zeldin says he wants to deploy 1,000 people for LA Fire cleanup a week after EPA told 1,000 employees they could be fired at-will. When disaster strikes it is frontline staff from across the agency who step away from their day job to respond. These are the same people.

As we head into Monday, DOJ has issued broad advice to agencies that they cannot "pause, freeze, impede, block, cancel, or terminate any awards or obligations" based on either the OMB Memo or the President's EO.

The judge’s order stayed implementation of the OMB memo but not the Executive Order itself. OMB withdrew the memo but EPA and other agencies continued to block all funds by pointing to the authority of the EO. The WH Press Secretary made clear that the freeze was still in effect.

On Jan. 27, OMB issued M-25-13. This memo directed agencies to “pause” all activities related to “assistance for...DEI, woke gender ideology, and the green new deal” by 5pm on Tuesday. EPA's CFO then issued an internal memo immediately freezing all BIL & IRA funds.

On January 20, Trump signed Executive Order 14154 (“Unleashing American Energy”) that directed agencies to “immediately pause the disbursement of funds” from the Inflation Reduction Act (IRA) and the Infrastructure Law (IIJA/BIL). NOTE: EOs do not give agencies special power to break the law.
