The bottom line is there are MULTIPLE companies with trademarks using #AsEver in some capacity and they haven’t said anything. As Ever NYC has been chosen by anti-Meghan groups as the ones to find justice for but they didn’t have a trademark so the law is not on their side.

Once Meghan Sussex’s trademark application is assigned and potentially approved, it will be added to the Trademark Official Gazette which is a weekly publication of all trademarks & any party who opposes it has 30 days to respond. That’ll be when we see what As Ever NYC does.

Can As Ever NYC use common law right to say they had the name first & have been doing business for years with it? Yes. But they didn’t do so for all the other current patents. Also their legal protections are significantly weaker because they lack a federally registered trademark.

Simply put, unfortunately As Ever NYC did not trademark their name which is why other companies like As Ever Photography listed earlier in this thread had their patent approved. Based on the current As Ever trademarks, Duchess Meghan’s has no overlap& will most likely be approved.

As well, I looked at As Ever NYC digital footprint and although they claim they have been selling product since 2017 until now, their last Instagram post was October 2023 before they posted about the current situation yesterday Feb 18th 2025. This may play into their legal stance.

The clothing business is “As Ever NYC” a naming convention they’ve used since they began in 2015-2017. Based on US patent & trademark laws, the addition of “NYC” is enough to differentiate from #AsEver. In addition, the clothing company simply did not trademark unfortunately.

I searched all other #AsEver patents & found many with this/similar naming including a photography company, many tshirt/clothing companies & even an adhesive stationary company. None of them were for As Ever NYC - the clothing company that has been caught in the middle of this.

This is publicly available information from the US Patent & Trademark Office. The trademark applications include for textiles, non medicated skincare, household linens & baked mixes, w/ 2 including the #AsEver cursive writing logo. These were submitted in September 2024 & are waiting to be assigned
