![The case of the Wharton family of Stafford County, Virginia, is
particularly illustrative of how marriage could change a person’s racial
status. The Whartons were a formerly enslaved family who had purchased
their freedom around 1830. After gaining their freedom, the family chose to
remain in Virginia. However, this was forbidden under the state’s 1806
removal law requiring all formerly enslaved people freed after May 1, 1806,
to leave the commonwealth. Any person who remained in Virginia more
than one year after their enslavement ended could be put on trial and, if
found guilty, re-enslaved and sold. The 1806 law posed a real threat to the
Whartons, but in 1833, fifty-one members of Stafford County’s white
community submitted a petition to the Virginia legislature arguing that the
1806 law did not apply to the Whartons and that they should be permitted to
remain.
Unlike the mixed-race individuals in Cantey and Boullemet, the
Whartons had personally been enslaved and unquestionably met the Cantey
definition of black. Nevertheless, the Stafford petition asked for a
declaration that the Whartons were “white persons” based on the family’s
appearance and the fact that their most intimate social connections — their
marriages — were with white spouses.[33] Shockingly, the legislature
granted the request. Despite all evidence to the contrary, it decreed the
Whartons were “not negroes or mulattoes, but white persons, although
remotely descended from a coloured woman.” The Whartons were then
permitted to stay.

![Cantey involved the racial status of three mixed-race men and,
specifically, whether their black ancestry precluded them from testifying
against a white man. The heritage of the men was not in question. It was
accepted that all three descended from a mixed-race man. Nevertheless, the
court held that the men were white because their ancestor had been treated
as white. As the court explained, the men’s “maternal grandfather…

descendants were legally white. According to the court, “For a person of
ambiguous appearance, evidence of reception in society and exercise of
legal and political rights could overcome evidence of negro ancestry.”[28] It
then cited the grandfather’s marriage with a white woman as conclusive
evidence the man had been accepted as white.[29]
Racial determination cases post-Cantey further confirmed that marriage
could secure a mixed-race person’s designation as white. In an illustrative
case from 1840, a Louisiana man named Stephen Boullemet brought a
slander suit against an acquaintance for starting a rumor that he was
“negro” and imperiling his impending marriage to a white woman. The case
turned on whether Boullemet was, in fact, black. To refute this racial
allegation, Boullemet presented evidence of acceptance by white society.
He called witnesses from the white community of St. Helena, Santo
Domingo, where he was raised, to testify that he was “received in good
circles of society — He was received as a white man.”[30] He also presented
