Partly because the shorts come with padding, and the tops with rear pockets. Mostly because specialist clothing is more comfortable and better suited than normal clothes for cycling. The same is potentially true for other "special" sports clothing such as wetsuits, wingsuit flying etc.

It's not "an offence" of course. You may cycle on the road if you wish. There's a cycle path for 200m of my commute. Broken tarmac, piles of wet leaves, and dark. I'll take the recently resurfaced road, thanks.
