you can tell the difference between an ape and a monkey by the tail. only monkeys have tails, but this is not always easily apparent
the barbary macaque has tail but it is so small it can be completely invisible! same with the japanese macaque, but their tails are slightly longer

2. having a pet monkey is illegal in most places, as it should be! because even though they're cute, living in a house or cage and being isolated from the social life of a wild monkey is very mentally damaging to them. look it up!

considering this is japanese art, it looks like this is a japanese macaque. they are also known as snow monkeys and are the same type of monkeys who live in the snowy mountains of japan and swim in hot springs!
