I think they’re incognito because most people, if they see a police presence around home/school/work, they would know to beware. It’s not til later that they show force. They know that now is not the time for that.

One way might be for the constitutionally savvy Dems like Raskin to propose a law requiring Congressional consent for the declaration of federal martial law.
The Constitution does not explicitly grant POTUS unilateral authority to declare martial law, but it has not been challenged in the past.
