She didn't strike the whole special prosecutor statute - she claimed in her dismissal that Smith wasn't eligible to serve in that role because he was pulled from elsewhere than inside DoJ. Even if she had, her ruling hasn't been tested on appeal yet, and is not precedential on other courts.

Well, by that token, Garland and Smith should *absolutely* release the report today, and let Cannon try to enforce her ruling after the fact.
