It’s a stupid argument! This is equating territory with popularity. By the “science” of numbers, Biden got 169,811 votes per country, indicative of large city centers. Trump had 29,636 votes per county, indicative of large areas of rural population.

The 1st Amendment has always been interpreted as any US government cannot make laws curtailing freedom of speech, religion, press, etc. Given the SCOTUS in place, I could see a Trump-era move to hone in on "Congress shall make no law" as a workaround for state & executive powers.
