IMO: today's gutting of NEPA by SCOTUS won't "unleash" anything other than enviro harms. Maybe we need an even stronger enviro law now 🤔

NEW: DC Circuit denies en banc rehearing for bombshell Marin Audubon #NEPA case

The case's holding eroded decades-old NEPA regulations--something neither party in the lawsuit asked for or even discussed. As someone said, "it fell from the sky." By denying rehearing, the decision stands.

Our case concerns rather bizarre offshore drilling islands. The islands may look "populated" but it's all a facade (literally!) to hide fossil fuel operations from Long Beach residents.

But as residents know, the fossil fuel drilling is all too real, and has been polluting for 50+ years 🧵

Always a privilege to hear Our Children’s Trust present. Here, Held v. Montana youth plaintiff shared so powerfully about their lower court victory.

The case was up before the MT Supreme Court in July; decision to come 🤞

❗ Big enviro law breaking news:
DC Circuit holds that Council on Enviro Quality (CEQ) doesn't have lawful authority to issue binding regs interpreting NEPA (a position no party in the case advanced.)

Still digesting what this could mean. CEQ had an Exec Order from Nixon to promulgate regs.

I’m still reeling from the election results (😱) but hanging this art by Roger Peet (@toosphexy.bsky.social) in my office helps, as it will surely be inspiration to keep going these next years.
