But bottom line - per the UCMJ, just like we can be punished for disobeying a lawful order or command, we can also be punished for obeying an order that we know is unlawful, and not saying anything.
Just because it comes from a superior officer, doesn’t make it lawful automatically.

Now, these are two very specific examples. And we can play the “what-if” game of roulette for hours with this. 👇🏾

Luckily this person knew the Navy instructions where it states that those things SHALL be provided.
For my definition, this would go against my 2nd and 3rd bullet. It’s against the objectives and goals of the force (allowing meals and breaks for positive morale and maintaining readiness). 👇🏾

Unlawful order go against one or more of those three points (as defined by me) that was stated earlier.
This next example is a solid example of an UNLAWFUL order.
This person was denied breaks, meals, and time for personal PT (physical training). 👇🏾

…refused, they were administratively separated aka kicked the fuck out. The DoD mandates that we get a flu shot every year. They don’t care if we like or not. The only thing that will get you out of it, is a LEGIT religious exemption.

At the time SECDEF Austin stated that we had to get the vaccine. That is a lawful order. It supports mission readiness and warfighter readiness, or the goals and objectives of the force.
It also wasn’t vague and didn’t violate the Constitution.

Lawful orders, to me, should:
1. Not be vague or ambiguous, but clear and detailed enough.
2. Support the objectives/goals of the force and/or the mission.
3. They cannot go against the Constitution in any way. Period.
An example was when we were mandated to get the Covid vaccine. 👇🏾

…a member of the armed forces, or to be derelict in performing duties. (Article 90 deals with disobeying orders from a superior officer - different topic for a different time.)
Now, I am not a JAG or lawyer nor am I pretending to be. This is my interpretation based off of my experience. 👇🏾
