The main thing that prevents stuff being automated is that robots are expensive and engineers are usually more expensive than the job you want to automate.

Indeed, regulation is better than criminalisation in almost any case where a black market might be involved.
That said I don't think we could go full Terry Pratchett and have a guild for every crime, but we can definitely regulate sex, drugs, and gambling.
