I’m a horror fanatic. My wife is … not. But she’ll watch one horror flick with me each year on Halloween.

This year it was Ready or Not. I’ve seen it a dozen times and it still rocks. Perfect horror comedy. 10/10.

It makes no sense to me that companies have standing to raise these types of challenges. Even if ALJ’s are unconstitutionally insulated from removal, the President should be the only one to have standing to raise that issue.

I don’t see this in the complaint, but it is also plausible that doctors would be harmed by facing greater exposure to infectious diseases. Regardless, Jane Doe definitely seems to have standing.

The author really doesn’t try to hide the ball. After arguing at length that the Constitution’s references to “the People” must be understood as including only “white Americans,” he ends with this horrifying conclusion.

That is blatantly untrue. In fact, the introduction of the paper makes clear that the author is making a “normative” argument the the principles of “national constitutionalism” be “preserved and aggressively asserted.”

Blackman says that the paper appeared to present its thesis only as “a matter of scholarship,” and it is only with the “benefit of hindsight” that “we know that the author was in fact also articulating his own policy preferences.”
