Indeed. But here's the twist (re 🇸🇪): one of the concerns was exactly the impossibility of making good copyright judgments by platforms (see ft. 71 in the paper 4 awesome reference) so the duty of care was essentially set to (lowered?) "if it's in the grey area, don't assess and let it pass".
