When our community is disappeared locally — disappeared from life into prisons — people on both sides of the bars are punished.

Holing human beings away does nothing to help society, heal community — and it disrupts their families, their loved ones, their children.

Here's a chance to mitigate harm
We are raising funds to help with the travel costs for incarcerated journalist Kwaneta Harris' children to visit her for the first time in a a decade. Kwaneta is a former nurse, business owner, and expat, now an incarcerated journalist and Haymarket Writing Freedom Fellow, from Detroit. In her writing, she illuminates how the experience of being incarcerated in the largest state prison in Texas is vastly different for women in ways that directly map onto a culture rooted in misogyny. Her stories expose how the intersection of gender, race, and place contribute to state-sanctioned, gender-based violence. Kwaneta has spent years of her life in solitary confinement, unable to contact her children even via phone calls for long stretches of time. Because her family lives in Detroit and Kwaneta is incarcerated in Texas, it is extremely costly and difficult to arrange in-person visits. This fundraiser seeks to help offset some of the costs of travel so that Kwaneta can see her children for the first time since 2015. Summer I was only four months old when my mama got arrested. That’s what my grandma told me. For most of my life, she’s been just a voice on the phone or a character in stories others tell me. I’ve only seen her twice in person that I can recall. The first time I was 4, but that memory is so hazy I can’t tell if I’m really remembering it or just reciting what others have told me about that day. The second and last time, in October 2015 at 7 years old, is when I truly remember seeing her face-to-face. Mama somehow managed to hold all three of us: me, my sister and my brother by our hands at the same time. But her eyes stayed on me the longest. My siblings look just like her, but I’m my dad’s twin, so I guess she was trying to memorize my face. We were getting to know each other, and I remember telling her she “talked like a white girl” because her voice sounded different in person than over the phone. Then everything changed in January 2016. Mama was put in solitary confinement, and she stayed there until just recently, when I turned 16. We had been talking on the phone daily—me in Michigan, her in Texas—and then it all just stopped. No explanation, just silence. Grandma was crying all the time. My sister started acting out, getting involved with boys and being bullied at school. Nobody really explained what was happening, they just said, “Mama’s in the hole.” I was only 8 years old then, and I thought she was literally living in a hole in the ground. I would lay awake at night worrying about how she ate, where she slept, how she went to the bathroom. That’s when my stomach problems started. Everything I did in my daily life, I’d wonder how Mama was doing the same thing in that hole. Was she cold? Could she see the sky? We were supposed to visit Mama every year. Her friends and other people would pitch in for the trip. But suddenly we couldn’t go because “she’s in the hole.” I started thinking maybe she didn’t want us to come because they might put us in holes too. I couldn’t talk to anyone about it because we weren’t supposed to tell people where our Mama was. I still don’t understand why me, my grandma, my brother and my sister all had to be punished too. They definitely succeeded at breaking our family apart. I had relatives on my dad’s side who were in Michigan prisons, and they came home on the weekends. Some of them even called home when they were in “the hole.” I didn’t understand that Texas had different rules. I was angry and convinced myself that Mama didn’t want to talk to me. We didn’t have phone calls anymore. Once, after years of silence, Mama called very late at night, grandma woke me up … but when I got on the phone, Mama thought I was my sister. That really hurt me, made me feel invisible.

Several courts have ruled that extreme temperatures in prison violate the Eighth Amendment’s provision against “cruel and unusual” punishment. But these rulings have not led to a widespread adoption of air-conditioning or other methods to cool prison facilities or prevent heat-related deaths. Public health researchers at Brown University estimate that just one day of above average summer temperatures is associated with a nearly 4% increase in prison deaths. Suicides spike 23% in the three days following a heat wave. And for every 10 degrees above the average summer temperature, prison deaths increase 5%. Joshua was shot numerous times at 1646. He did not receive any help for almost 10 minutes. And then only after he was frisked and dragged.

Video begins at 1646:07 and shows Ofc Lesser driving his patrol vehicle. He arrives on scene at 1647:30 and enters the complex via the Cora Ave entrance. He contacts officers at the bottom of the stairs leading to apartment #. After a plan is made to contact Musselman's apartment, Ofc Lesser accompanies a group of officers as they walk up the stairs and into the apartment. Ofc Lesser assists Ofc Valencia in clearing the hallway, closet and bathroom then returns to the kitchen. Ofc Lesser drags Musselman fully into the kitchen, performs a frisk for weapons and assists in providing medical aid, placing a chest seal over the injury to Musselman's left chest (1653:07). He places a second chest seal over the injury to Musselman's left back (1653:23). Ofc Lesser begins performing CPR on Musselman at 1654:16. At 1655:19, Ofc C Lesser passes off chest compressions to Ofc S Lesser. Fire personnel arrive on scene and take over CPR at 1656:14. At 1700:31, Ofc C Lesser began chest compressions, taking over for fire personnel. At 1702:45, Ofc C Lesser stopped compressions, handing off duties to fire personnel again. Medical aid continued to be provided until death was pronounced at 11716 (sic) hours. Ofc Lesser remained in the apartment until medics left, at which point he left the apartment at 1719:05, walking to the base of the stairs and contacting other officers. "Let's start with the medical stuff" after waiting until someone says Joshua is down, waiting to climb stairs, waiting to clear hallway, closet, bathroom.
A plan is made to make contact with Musselman's apartment and together with numerous other officers, Ofc Valencia moves to the stairwell and begins moving up. At 1651:17, Ofc Valencia vocalizes that he sees a rifle. At 1651:31, Ofc Valencia advises he sees Musselman and continues up the last flight of stairs and into the apartment. An officer is heard announcing "Police, Police, Police! If you're inside, make yourself known!" Ofc Valencia enters the apartment and turns left, clearing a hallway, a closet, and the bathroom. He then returns to the kitchen where officers are seen continuing to ensure the apartment is clear. When the apartment is declared clear, Ofc Valencia says "let's start with the medical stuff." Numerous officers begin providing medical aid to Musselman, who has been pulled into the kitchen to provide more room for treatment. As aid is being provided, Ofc Valencia identifies potential bullet defects in the edge of the counter below the kitchen sink. At 1657:37, Ofc Valencia leaves the apartment and returns to the parking lot. He walks out to Post St where he contacts Sgt Gonsalves. His camera is deactivated at 1659:43. A second video beings at 1715:36 and shows Ofc Valencia walking across the parking lot of the complex. He proceeds up the stairs to apartment # and contacts the resident. The resident shows Ofc Valencia the damage from likely projectiles penetrating into her apartment from apartment #. He requests a corporal for photos. He has a discussion with the resident and looks for a projectile before leaving the apartment and contacting other officers at the bottom of the stairwell leading to Musselman's apartment. He deactivates his camera at 1728:37.

The woman described so callously had bullets tear through her walls. She was terrified. She didn't know yet her neighbor was dead, but she knew she almost died herself.

Then someone started breaking her door down.

Terrifying.

It wasn't until the 4th kick she knew police were attacking her door.
Ofc Valenia beings running across the parking lot towards building "A" with several officers following. He arrives at the stairwell which leads up to apartment #A[neighbor] and starts up the stairs. He pauses on the landing just below the apartment door and asks if other officers have a visual on "him" (Musselman). Ofc Valencia continues up the last set of stairs and stops in front of apartment #[neighbor]. He says, "okay, breaching," and proceeds to deliver four kicks to the door without effect. On the fourth kick. an officer yells out "Police!" while another yells "Spokane Police!" Four more kicks are delivered, also without effect. A muffled female voice can be heard, though the many of the words are unintelligible. Ofc Valencia stops his attempts at breaching the door as an officer yells "Spokane Police." A female opens the door with her hands raised asking "What happened, what happened?" Ofc Valencia enters the apartment and has the female step out the door as another officer asks if there are any children present. The female responds "No, my son's not here." accompanies Corp Johnson to check on building "B" apartments. After making contact with numerous residents, Ofc Spring returns to the lot and observes a possible defect in a garage in front of building B. As he is returning to the lot in front of building "A," he deactivates his camera (1705:09). A second video begins at 1735:19 and shows Ofc Spring speaking with Sgt Gonsalves. He is standing in the lot near the base of the stairs leading to Musselman's apartment (which is now taped off with red crime scene tape. Ofc Spring contacts the resident of # Anwar Peace, who is trying to return to his apartment. Peace had been allowed to leave his apartment for the laundry room prior to the inner perimeter being established. Ofc Spring tells Peace he cannot return at this point because the perimeter has been established and that the county (SCSO) is now in charge of the scene. Ofc Spring continues to speak with Peace for a few minutes and then escorts him around the building to where his vehicle is parked behind building "A." Peace does NOT return to his apartment through the perimeter. Ofc Spring deactivates his camera at 1743:32. Nothing else of note is captured on body worn camera footage which is not covered in his report.

SPD made contact with a different building, entered someone's apartment, and had a view of Musselman's apartment.

They did this AFTER they killed Joshua.

Sheriff's report makes sure to include officer "ensures he is not injured" as if they are the ones preventing injury, rather than inflicting it.
Video begins at 1642:34. Ofc Spring is seen walking through the lot of the complex towards building "F." He contacts numerous officers where they are in a position of cover behind a vehicle in front of building "F" at the north end of the garages. After contact with Corp Johnson, he and other officers eventually make their way to a location in front of building "C" where they have a view of the landing in front of Musselman's apartment. At 1646:22, numerous shots are heard. Shortly after, numerous officers can be heard yelling for people to stay inside their apartments. An officer is heard asking for officers to accompany him (Ofc A Valencia) to apartment #A. Ofc Spring remains in front of building "C" until 1649:12 when Ofc D Valencia arrives and requests officers accompany him to and (sic) apartment in building "C." Ofc Spring accompanies Ofc Valencia and several others to apartment #C where they are granted access to the apartment. Ofc D Valencia and Ofc Spring eventually enter a bedroom which grants them a view to Musselman's apartment. Officer Spring leaves #C when as other officers are contacting #A and returns to the lot. He makes contact with #A and #A and ensures he is not injured. He then

UPDATE!

Joswar and César are still in Tacoma ICE Detention Center in inhumane conditions. Joswar's asylum hearing is later this month (August) and César's is in October.

Their lawyer is working 7 days a week, also in deplorable conditions.

They're still fighting.

Thankfully, due to your generosity, we have an outstanding lawyer and remain hopeful they can stay in the United States. Never voted against police funding increase. Always get whatever militarized upgrades and weapons they ask for.

Previous President Beggs admitted they've never denied requests for increased police funding — coded as "public safety" — ever a few years ago.

Big Business gets from Gov what they ask.

I personally endorsed both ideas and am open to hearing more specific ideas. However, four days before that post, on Aug. 23, university administrators quietly approved a new policy limiting all protests on campus, without the usual student and faculty feedback process that informs university policy decisions. The policy, which went into effect two days before students were even notified it existed, was created to “prioritize the safety and well-being of all community members, while creating opportunities for civil discourse, founded in our shared mission of being people for and with others,” according to an email from John Sklut, the chair of the university’s Policy Coordinating and Advisory Committee. To the contrary, students and faculty members argue that the policy will prevent them from many forms of protest they have historically used to hold the university accountable, following a nationwide trend of universities moving to limit speech after last year’s campus protests against the ongoing genocide in Gaza. Though Gonzaga spokesperson Jamie Aitken said student protestors last year “did a very good job” expressing themselves respectfully, and he was unaware of any Student Code of Conduct violations at demonstrations, it was still necessary for the university to move quicker than the usual policy process to create guidelines for protesting before the new school year started on August 27. RANGE tried to get more detail regarding the need for urgency with the policy— especially since campus protests remained peaceful last year — but did not receive a clear answer from administrators. “These are complex times. When was the last time something like this was happening across campuses, across the US and across the globe?” Aitken said. “When has that happened?” Aitken, who was not with Gonzaga in 2020, was unable to explain the university’s differing response to last year’s protests — the creation of a new policy to limit protesting — and its response to the 2020 national protests after Minneapolis police murdered George Floyd, when then-Provost Deena Gonzalez sent an email to all staff and students that read, in part: The policy bans demonstrations and speech on campus that include: Protesting on campus by “third parties” — anyone not a current student, staff or faculty member, including alumni, family members and community groups. Protesting in buildings. Protesting before 8 am or after 8 pm Protesting that is so noisy it interferes with people’s “use of nearby university buildings,” “subjectively reasonable residence hall room use expectations” or “city of Spokane noise ordinances.” Protesting that prevents anyone else from expressing their views; for example, playing the trombone or standing with a large sign in front of another protestor. Protesting that blocks any campus roads, paths, sidewalks, parking areas or building entrances and exits. Leaving or displaying signs, posters or banners used during a protest. (If the student in the Instagram holding the “No Justice, No Peace” sign left her sign on campus or displayed it by hanging it from any campus building, she could be in violation of this rule.) Using chalk or other substances like spray paint or permanent marker on university surfaces. Projecting images or hanging banners on university buildings without prior written approval. Drumming of any kind for more than five minutes per hour.

4 cops sprayed 15 wall penetrating bullets and then ignored Joshua for *an unknown amount of time* because the Sheriff's refuse to put times down for that.

After Ofc A Valencia's arrival, Ofc Adkinson accompanies him and other officers to apartment #A__, ensuring no injured parties are inside and evacuating the occupants. He then returns to the base of the stairs where a plan to contact apartment #A__ Musselman's apartment, to ensure there is no one inside in need of aid, is put together. Ofc Adkinson accompanies numerous officers to Musselman's apartment. Once the apartment is clear, an officer is seen pulling Musselman into the kitchen to allow room for medical aid to be provided. Ofc Adkinson assists in cutting Musselman's clothing away from his torso and identifying injuries. After leaving the apartment, Ofc Adkinson contacts numerous apartments and gathers the names of the occupants. He deactivates his camera at 1716:37. Bridging the Divide: Understanding the Human Cost on Both Sides of the Badge on “Use-Of-Force” & “Use-Of-Force-Fatalities” in our community, which Spokane ranks 3rd in the nation for Officer-Involved-Fatalities. This event will feature guest-panelists that are subject-matter-experts on this topic from both police leadership & "Impacted-Families". The list of the panelists are as follows: Spokane Police Chief Kevin Hall, Spokane Police Ombuds Bart Logue, Debbie Novak (Washington Coalition for Police Accountability-WCPA), Kurtis Robinson (Washington State Criminal Justice Training Commission-CJTC), Jim Leighty (WCPA), and Cynthia Manycolors (WCPA). SPD killed one of us in a mental health crisis. LE was aware Joshua was mentally ill and talking to no one right before they killed him.

At 1651:17, an officer is heard announcing the presence of a rifle. As Ofc Matlock reaches the landing, a rifle is visible leaning against the railing just outside Musselman's apartment. Numerous officers make entry into the apartment. Musselman is seen lying on his back with his upper body in the hallway and his lower body in the kitchen/entryway. After ensuring there is no one else inside the apartment in need of assistance, medical aid is provided to Musselman by other officers until medics arrived and took over. Ofc Matlock leaves the apartment and contacts several apartments, gathering their information and verifying no one inside was hurt during the incident. He deactivates his camera at 1711:09. A second video beings at 1714:17 and shows Ofc Matlock standing at the bottom of the stairs leading to Musselman's apartment. He and Ofc Weber are then showed contacting residents in apartments #C__ and #C__ and pointing out damage to the building's siding to Corp Matt. He deactivates his camera at 1720:39. There is nothing of note seen in the body camera footage not covered in Ofc Matlock's report.

Ofc Matlock: Video begins at 16:40:05 with Ofc Matlock seated in the passenger seat of a patrol vehicle. Upon arriving at the Cora address, he contacts other officers at the south entrance to the complex. After retrieving a ballistic shield from a vehicle, he and other officers enter the complex and move to a location in front of building "F" at the south end of the property. Eventually, Ofc Matlock and the officers with him move north to a location in front of building "C," just south of the garages. Shortly after arriving at this location, Ofc Matlock and the officers with him identify the target apartment and take a position which allowed them a view of the landing in front of Musselman's door. At 1646:22, numerous shots are heard. Immediately after the shots are heard, numerous officers can be heard telling people to go inside. Officer A. Valencia arrives and requests three officers accompany him. Ofc Matlock joins this group, runs across the lot to apartment A Redacted and makes contact with the occupants after several attempts at breaching the door. The four occupants are escorted out of the apartment and found to be unharmed. Officer Matlock leaves the apartment and gathers with numerous other officers at the bottom of the stairwell. A plan is made to enter the target apartment, A Redacted and together, they all travel to that stairwell and up to the third floor.

Jim Leighty, a police accountability activist and the person who obtained the report this story is based on, said the officers did several things wrong during the response. “Instead of using less-than-lethal or perhaps using something that would be less likely to penetrate a wall, all of them chose to go with an AR 15 platform with .223 rounds,” Leighty said in an interview. The bullets have “jacketed tips that will, when they’re shot, go through a person. They’ll penetrate a wall.” At least three of the rounds went through the exterior of Musselman’s apartment, through the opposite wall and into the next door apartment of Alexis Stojsic, who is the mother of a toddler. Months later, the bullet holes are patched up but still visible near a mirror mounted on the east wall. Before the shooting, Stojsic said her son liked to stand on the couch and look at himself in the mirror, placing himself exactly in the bullets’ path. “The bottom one lines right up with the head,” she told RANGE, referring to the bullet holes. “It gives me goosebumps.” Her son was not home when the shooting happened, but Stojsic said she has rearranged her furniture to make him safer from bullets. “They didn’t even slow down and take into consideration they were shooting into an occupied apartment building with rounds that they knew could go through walls and kill people in other apartments,” Leighty said. Leighty, the police accountability activist, said the officers who returned to the complex did not follow state-mandated training for police, which requires them to understand the situation, establish communication with suspects and give them time to understand and follow commands when safe and feasible. Musselman “didn’t know they were out there,” Leighty said. A deadly history Three of the four officers who shot Musselman have shot at civilians before. The Sheriff sent the SIIR report on the Musselman killing to Haskell in April. Acting prosecutor Preston McCollam told RANGE he could not confirm whether his office had received the document and didn’t know how long it would take to determine whether he would prosecute the involved officers. After Musselman’s killing, his sister retained the high-profile lawyer Rondi Thorp, who has won large settlements from the City of Spokane on behalf of families of police shooting victims, including a $4 million settlement with Debbie Novak in 2022 after police killed her son David in 2019. Thorp also represented the family of Robert Bradley, who was killed in 2022 by Spokane police. Just this month, the city agreed to a $3.7 million settlement with Bradley’s family. In all those killings, Haskel had found the officers justified. The officers who killed Musselman are currently on full-duty status, SPD spokesperson Daniel Strassenberg told RANGE. Strassenberg declined to answer specific questions about the killing because SPD is conducting its own probe into the case.

At 4:42 pm on December 29, 2024, Spokane Police Department (SPD) officers stationed themselves on a hill that gave them a clear view of Joshua Musselman through the open front door of his third-floor apartment. They were there because a neighbor complained he had been shooting a rifle into that same hill, just north of the Northcliff Terrace apartment complex, earlier in the day. As they watched him, Musselman, 29, walked onto the landing to “roll a joint,” according to a newly-released investigation of the killing. Minutes later, at 4:46 pm, the police opened fire from the hill, and Musselman was dying in a hallway just inside the door. The investigative report from the Spokane County Sheriff’s Office says Musselman was not armed when the police arrived, despite the neighbor’s complaint. The police were about 100 feet away from Musselman: “a little too far for verbal” commands, SPD Officer Garth Craigen, one of the men on the hill that day, said, according to the report’s narrative of body camera footage. Craigen’s story is contained in the report, which was issued by the Sheriff’s office as part of a mechanism called the “Spokane Independent Investigative Response Team” (SIIR). It’s a local group of law enforcement agencies set up so when officers in one agency kill someone, a different agency in the group steps in to investigate to avoid conflicts of interest. The report said a communications team in the apartment complex parking area had not yet established contact with Musselman when the officers took their position on the hill. It describes no attempt to “deescalate,” or make the situation less likely to result in physical violence. The officers tried to stay out of Musselman’s view, the report says. The officers — Garth Craigen, Will Mitchell, Matthew Stewart, Daniel Valencia — said Musselman’s rifle was leaning against the wall near his apartment door when they arrived. The officers say Musselman saw them and picked the weapon up, but the report could not corroborate this. “I am unable to determine if the subject seen moving [at the time Musselman walked outside] is holding anything in his hands,” wrote detective Marc Melville, who used the officers’ body camera footage to author much of the SIIR report. Seconds later — less than five minutes after the officers took position — the officers opened fire, leaving Musselman dying of “multiple” gunshot wounds, according to the documents. The four officers who shot Musselman had fired a total of 15 .223 rounds from AR-15 patrol rifles at Musselman, a deadly caliber known for its ability to penetrate more than one target. They came in rapid succession just before Valencia called, “Hold fire,” the report says. “It should also be noted that when the first shot rings out, other shots are heard almost simultaneously,” Melville’s report says. The rifle Musselman had turned out to be a Gamo airsoft rifle, a type of BB gun, which can cause harm and in some cases death, but is generally not considered to be lethal. According to the report, the rifle was found leaning neatly against the railing before the officers entered the apartment to render first aid.
