Im pretty sure even Apple and Google don't like to commit federal crimes if they can help it, the penalties could include severe sanctions and actual people being charged with criminal activity. I don't know how much legal recourse they have in the courts over it, or if it's worth it to them either.

From what articles say, it's updating, maintaining, and distributing the app that will be largely illegal. This applies to the companies, so they'd be hit with fines and other legal issues if they did do that. Seems like we can keep using it, but security issues will arise as updates arent made.
