If someone is good with stats it would be interesting to see how accurate this is.

Internal review was requested and awaiting a response ( they asked for extra time) now coming up to 3 months since review was requested.
We are writing to advise you that following a search of our paper and electronic records, we have established that the information you requested is held by the Cabinet Of ice. The information you have requested is exempt under section 35(1)(a) of the Freedom of Information Act, which protects the formulation of policy and communications between Ministers. Disclosure would weaken officials' and Ministers' ability to discuss controversial and sensitive topics free from premature public scrutiny. Section 35 is a qualified exemption, and we have considered whether the balance of the public interest favours our release of this material. There is a general public interest in disclosure of information, and we recognise that openness in government may increase public trust in and engagement with the Government. We recognise that government decisions may have a significant impact on the lives of citizens and there is a public interest in government deliberations being transparent. These public interests have to be weighed against a strong public interest that policy-making and its implementation are of the highest quality and informed by a full consideration of all the options. Of icials and Ministers must be able to discuss policy freely and frankly, exchange views on available options and understand their possible implications. The candour of all involved would be affected by their assessment of whether the content of the discussions wil be disclosed prematurely. If discussions were routinely made public there is a risk that officials and Ministers may feel inhibited from being frank and candid with one another. As a result the quality of debate underlying decision making would decline, leading to worse informed and poorer decision making. Taking into account all the circumstances of this case, we have concluded that the balance of the public interest favours withholding this information.

Download just responded to our enquiry as to it policy of excluding trans people.

WE dis an FOI request to the Cabinet office around communications between the ministers and the EHRC and other outside agents that contained conversation about transgender people.

They refused under section 35 as we predicted.

So we have requested an internal review..we await a response.
You acknowledge the requested information is held by the cabinet office but under section 35 of the freedom of information act you are choosing to withhold. The refusal issued constitutes a blanket non-disclosure, which I believe is contrary to the public interest. The use of exemptions without evidence of a public interest test being adequately applied or documented raises serious concerns. Grounds for Review: Public Interest Over Exemption Use. The decision to withhold all information under Section 35 does not appear to have balanced the legitimate and compelling public interest in transparency. Your response stated "There is a general public interest in disclosure of information, and we recognise that openness in government may increase public trust in and engagement with the Government. " You acknowledge release of information is beneficial in fostering trust in the government, something given the current highly charged debate around trans people lives and their very freedoms to live a full and free live within these shores A full refusal, without redactions or partial disclosures, suggests that the authority has not reasonably considered whether any portion of the information could be released and in so doing is increasing public mistrust in the government acting in a fair and equitable manor. I believe this alone is strong ground for release of this information. Transparency particularly where it concerns issues of human rights, equality, or institutional accountability is highly important when it comes to decision that may or may not curtail freedoms of citizens of the United Kingdom. A full refusal, without redactions or partial disclosures, suggests that the authority has not reasonably considered whether any portion of the information could be released and leads to the question why and what is being hidden? You further stated "Officials and Ministers must be able to discuss policy freely and frankly, exchange views on available options and understand their possible implications." While I accept this premise the public has the right to know that ministers are being given all the relevant information and not selected sources that bias decision making in one way or the other. How can the LGBTQ+ community, in particular the transgender people of this country have confidence that the government is not colluding with a small number of special interest lobby groups while refusing to engage with the very people impacted by policies around trans and LGBTQ+ inclusion. Release of the information requested would, if shown to be a balanced mix of stakeholder, go some way to reassure the public that all parties were being considered. I believe this public interest consideration has not been applied here as there is very significant interest around the rights and protections of transgender people in the UK at this time and transparency and thus trust in governance must over ride any hesitation to release.Lack of Justification and Detail in Refusal The refusal letter lacks sufficient detail on: How the exemption applies specifically to the information requested; Whether harm from disclosure has been reasonably and specifically considered; Whether any part of the information could be disclosed with apropriate redactions; Failure to Consider Segregability. Under FOl legislation, public bodies are obliged to consider whether non-exempt information within documents can be released even if other parts are exempt. This principle does not appear to have been applied. Transparency and Accountability Obligations. Where the information requested relates to a matter of public concern or human rights, such as trans rights, institutional positions on equality, or policy implementation the threshold for withholding information should be higher, and the justification for doing so more robust.

Dear Jonathan, Thank you for reaching out. We will not be participating in any interviews or providing comment for The Times. We have observed a consistent pattern of coverage in your publication that contributes to the marginalization and misrepresentation of transgender people. We have no interest in engaging with a platform that perpetuates transphobia under the guise of journalism. Please consider this our formal response to any current or future requests: we will not be cooperating with The Times until there is a significant change in the biased editorial position you currently hold.
