After Judge Currie's opinion, does DOJ have ability to refile indictment of Comey?

Can/will DOJ appeal dismissal?

What happens to privilege violations, can Comey pursue?

There’s one thing we should truly be thankful for: the boundless incompetence of Trump and his accomplice. — If democracy is to survive, we absolutely must ensure that all those smarter, would-be dictators waiting in the wings never ever get a chance to seize political power.

DOJ may re-indict, but limitations apply: 18 U.S.C. § 3288 allows a new indictment within six months of a dismissal if the statute of limitations has already expired.

Is this likely?

Will they also appeal?

How long until the DOJ moves to stay and appeal this decision?

Or, will they swallow it to try to keep using privileged emails in another corrupt case?
