Merrick Garland’s mistake was making Donald Trump an aggrieved martyr. It reinvigorated his supporters who had diminished in the wake of Jan 6. Of course, hindsight is 20/20.
This was Kennedy’s folly. He was such a free speech purist that he didn’t really think through what it would do to this country. Now his actual triumphs will be undone as a result of Citizens United, like Obergefell.
