The judicial review is now seen as a "stitch-up". So if the proscription is upheld, public faith in the judiciary will be lost and if these judges somehow happen to de-proscribe, the original proscription will be seen as even more ridiculous than it is already.

Not all police forces in the UK are arresting these DOJ protesters. Although no doubt coerced, the Met chose this pathway. Perhaps judicial review can get them and the home secretary off the hook and deproscription can be blamed on the "enemies of the people" as the Daily Mail called them

The government is in a hole but keeps digging.
They, like the Met, probably hope that a forthcoming judicial review will declare Coopers decision as illegal, then it can be claimed that "the enemies of the people" demanded the climb down, and they can be righteously indignant.
