I’ve been reading through NML with a friend. We just got to the part where Ratcatcher fights Robin. He’s a lot more…intense than I remember!

Former President Trump first asserts that the prospect of potential post-Presidency criminal liability would inhibit a sitting President’s ability to act “fearlessly and impartially,” citing the “especially sensitive duties” of the President and the need for “bold and unhesitating action.” Appellant’s Br. 21– 22 (quoting Fitzgerald, 457 U.S. at 745–46). But “[t]he chance that now and then there may be found some timid soul who will take counsel of his fears and give way to their repressive power is too remote and shadowy to shape the course of justice.”

Geez @kenwhite.bsky.social, I subscribe to Serious Trouble and all of a sudden judicial estoppel just starts showing up in my random Wikipedia searches, like this one on Terry Moore, who claimed she secretly married and never divorced Howard Hughes.
The Texas courts rejected Moore's claim of being Hughes' widow based on judicial estoppel; since Moore had claimed in her divorce from Cramer to have been married to him in 1959 and received a property settlement in that case, her claim that she was married to Hughes at the time was inconsistent with that and would not be accepted.
