SLAI CONDEMNS INTRUSIVE SURVEILLANCE OF LAWYERS BY POLICE On 24 September 2025, Angus McCullough KC’s review (the McCullough review) of covert measures used by the Police Service of Northern Ireland (PSNI) against journalists, lawyers and others with ‘special status’ was released. This review was designed to allay concerns raised last year as a result of disclosures made in hearings before the Investigatory Powers Tribunal in the UK, to the effect that the PSNI may have engaged in unlawful surveillance of journalists and lawyers in the North of Ireland. The findings of the McCullough review in fact compound these concerns. The report reveals the poor understanding of legal privilege by officers seeking surveillance authorisation, with the result that privileged material would be regularly obtained through these covert measures. It reveals that solicitors were subject to covert measures dozens of times in a period spanning 14 years. But it does not end here. Shockingly, the PSNI directed surveillance at a courthouse – twice. The propensity to pick up privileged matters is heightened by the potential for collateral surveillance of multiple lawyers in their place of work. The Socialist Lawyers’ Association of Ireland utterly condemns these reprehensible actions on the part of the PSNI. The North of Ireland has a dark history of state-enabled violence endangering the lives of those who act fearlessly and impartially in their clients’ best interests. Placing lawyers under intrusive surveillance does nothing to remedy this history. Though we note that the recommendations of the McCullough review are designed to ensure better compliance with the legal framework underpinning covert measures, the legal framework itself is breathtaking in its sweep and reach. No one is made safer in the face of state interference with the fundamental building blocks of justice and the rule of law.
