A morality that does not have contempt doesn't have a distinction between good and bad. The idea that it is moral to valorize a race to the bottom is what created this state of affairs in the first place. All of the content of a moral system exists in who is considered deserving of contempt.

Yes but the supreme court just ruled that not applicable to public bathrooms. And yet people's focus is on the SC and the EHRC when the actual problem is that the Equality Act and the EU directive are not good enough.

I'm familiar. That doesn't contradict anything I said. Higher courts making nuanced judgements on hard cases do more than read one paragraph from a quangos guidelines. People do not benefit themselves by having undue confidence in their poor understanding of complex legal decision making.

I don't claim to be an expert on the jurisprudence of article 8 but the phrase "private life" in this context basically means "what you do in your own home." So it's not wrong for the ECHR to say that it would likely be found not relevant to the use of a public bathroom in a court of law.

The problem is the political ontology of journalists, who insist that every question has to come down to an arbitrary choice of binary "sides" so they can claim impartiality. That's not how reality works, most meaningful questions do not have an uncontroversially left Vs right stratification

It is normal to produce new or updated statutory guidance in response to a court judgement of this nature. SG isn't determining the rules, it's explaining to non lawyers what the current understanding of the judicially accepted correct interpretation of the *existing* legislation is.
