So I kinda need some professional input here...

Can any artist who takes on commissions please tell me what I should do in this situation?

(And again sorry if I might've come across as whiny or anything in this post, it's just been so long and I don't know what to do anymore 😭)
This might come off as if I’m venting and I’m sorry about that. I just don’t know what to do in this situation. In early 2024 (around May), an artist I liked explained that they were struggling financially. At the time, even though they were in the process of doing a commission of mine that they managed to neglect for over a year, I was in an alright place financially and decided to commission another piece (about $180) from them. I’ve commissioned this artist before, with them going out of their way a few times to message me, asking me to commission them or, in one case, just outright asking to borrow money with the promise of repaying (which they haven’t). A few months after commissioning the piece (around July), I had to quit my job (due to being singled out and constantly targeted by my boss) resulting in me immediately being put in an awkward place financially. I checked in with this artist to see where they were in the process of my piece to see if it was possible to get a refund. When they told me that they had started it, I explained my situation to them and asked them if it was possible to get a refund. I even re-checked their TOS which allowed it at the risk of being blacklisted (which I completely understood and thought was fair). They explained that they wouldn’t blacklist me but since the commission itself was during a time of need, they didn’t have the money at the moment but would issue me the refund within the week. The problem is that I never got the refund or commission. I’ve been trying to contact them this past week to find out what’s going on, and I could be overthinking it, but it feels like they might be intentionally avoiding me. What should I do?

I made the silly choice to stay up for 24 hours straight to work on the Vtuber model I've been practicing on and now I'm not sure if I'll be able to stream today...
