I want preservation too, I'm pretty sure we all do. But we have to be honest about unintended consequences if we want legislation that actually works. Saying “I don’t think that will happen” might come from a place of good faith, but bad actors aren’t operating in good faith.

I'm not moving goalposts. I'm digging into why that hypothetical matters. Whether it's for profit or not, if people are incentivized to DDoS games out of existence just to get access to server binaries, that's a real structural flaw in any law we get passed.

Why buy the game when you can force the company to go bankrupt and they release their code to host servers for free?

Okay so it's been as long as the video has been out since I've last saw it, but if you're describing Thor's hypothetical correctly, I think you missed the point. If people are able to DDOS a games server and cause a company to go out of business just to release server binaries, that's the problem.

Don’t get me wrong, SKG had a good outline. But even in the FAQ they were too vague from a legal standpoint. If you’re trying to convince a bunch of boomer politicians that your cause is worth it, you should probably work out how to make your case.

Thor makes a video 10 months ago basically outlining what SKG needs to change so that they don’t sound so vague and they decline. So now that the movement is failing, instead of seeing if there’s anything they can change, they decide to put a 10 month old video on blast.
