Something I’ve said a lot in recent years, and it’s a concept a lot of people don’t seem to grasp, is laws only matter insofar as there is a mechanism enforcing those laws. Beyond that, laws are just words.

Not that police officer training is great, generally speaking, but the military has exactly zero training when it comes to policing large groups of people. With the exception of military police maybe, but those guys don’t have experience patrolling streets full of pedestrians.

Garcia isn’t the only person he deported illegally. Trump has deported and not brought back dozens of people against court orders.

And even in the Garcia case, Trump didn’t return him when he was told and only brought Garcia back to put him on trial.

It’s reality. Just look at the number of abuses Trump has gotten away with because others don’t hold him accountable.

A law only matters as far as someone being willing to enforce that law. If no one enforces it, it’s just words.

Yeah, the bottom line is who’s deciding what is and isn’t unlawful. A military member saying “no, that’s unlawful” isn’t the end of it. We can think something is unlawful all day, but ultimately those in power get to decide whether or it is.

Yeah, this is exactly it. Who gets to decide whether an order is or isn’t unlawful? That’s the reality. As much as we’d like it to be easy for soldiers to say “no, that’s unlawful,” the current state of our government is much too complex to make it that cut and dry.

Unfortunately, whether or not it’s lawful isn’t the calculus these soldiers are going to operate under when the more likely outcome of not following Trump’s orders is a court martial.

Now if it gets tied up in the courts or some judges shut it down? That’s different.

Sure, but if the president says it was lawful and the governor says it wasn’t, who is more likely to win out?

I’m not prescribing or suggesting the Guard members do anything specific. I’m just pointing out that it’s not as simple as “you’re in the Guard, do what the governor says.”
