There is a code of conduct that sets out canons of ethical behavior, which certainly prohibit engaging in activity that could be perceived as political and others that would make it difficult to speak or write, outside of a specific case, about alleged impropriety by the government.

They have to decide the cases before them but they are not free to speak out beyond that about anti-democratic actions. By stepping off the bench this senior judge can truly speak out.
