That’s the best way now. If 230 is repealed, then you won’t have an option to “say” you’re a bulletin board. You’ll just be a publisher because a publisher is one who partakes in the defamatory publication. If there’s a replacement for 230 then that’s a different story, but repeal means liability.

Platforms would have to shift to a pre-approval model for all posts pretty quickly.

They may be able to hide behind actual malice for a case or two, but if a couple people report something, they still don’t take it down, and then some damages accrue after that, then there’s your knowledge of falsity and/or reckless disregard for the truth. The pressure on moderators would be huge.

Should go without saying, but if they repeal 230, defamation lawyers will sue the platforms into oblivion in short order. Seems like not many people are contemplating this very obvious consequence, or the profound impact that potential liability would have on the internet as we know it.
