Ist es nicht sogar so, dass ersteres die neutrale Position ist, wenn man die Entscheidung in die Hände des Bundesverfassungsgericht gibt? Damit positionieren ich mich ja weder für noch gegen ein Verbot während alle, die das blockieren eine Position beziehen.
