If this is an Article 78 seeking a Writ of Prohibition, it's misleading to call it suing the judge as NYT does. Sure, the judge is the nominal defendant, but he's just asking AD1 to prohibit the court from holding the trial right now. They could just say he's asking for an order blocking the trial.
