In Letitia James’ vindictive/selective prosecution motion, she uses against govt AG Bondi’s own 10/31 backup order appoointing Halligan as “special atty.” If necessary, Bondi wrote, Halligan’s “special atty” appointment would apply only to James & Comey cases—showing selective treatment.

Actually, seems that prosecutors didn't even possess the recordings as of 10/31, so there's no way Bondi heard them. (I just deleted an earlier tweet speculating about the recordings.)

Next week's vindictive prosecution hearings in USA v Abrego Garcia have been POSTPONED until 12/8 and 12/9. It looks like the judge wants to study the documents and make an omnibus ruling on their admissibility & the govt's motions to quash subpoenas to DAG Todd Blanche et al.

The 9th Circuit’s decision to rehear en banc Oregon v Trump (the Portland National Guard case) is likely mainly about the level of deference due to a president. But Oregon had also flagged a big factual mistake in the panel's understanding of figures the govt used at oral argument.
