The NYSBA Prof'l Discipline Comm report concludes that Rule 8.4(h) "should be withdrawn entirely" or (if abolition can't happen) "should be limited to situations in which there are other provable rule violations, or ... the conduct is 'flagrantly violative' of accepted and known professional norms."

The New York State Bar Association Committee on Professional Discipline has recommended abolishing or amending Rule 8.4(h) (a lawyer shall not engage in "conduct that reflects adversely on the lawyer's fitness as a lawyer."

Thoughts? Has Rule 8.4(h) been used wisely or wickedly where you work?
