Seriously!

Cool, thank you!

Wait is this a specific app you are using to listen to OAs?

A lot of conservative originalists would say you’re either complying with the law or you’re not. Full stop, spirit/intent be damned. At least they would say that about other laws…

Just curious, why isn’t she “Judge Kollar-Kotelly”?
December 19, 2025 at 11:36 PM
All else aside, why are we handing such a random third party the button, rather than say, the woman herself?

Also, this dude has no “post-grad years”!!!

This is interesting because it depends so highly on the politics of the state where the lawyer is barred. Do we think the Ohio bar is going to discipline the dudes in OLC who sanction boat bombings?

So IJ Taylor was the judge assigned to Abrego Garcia’s case prior to yesterday?
December 13, 2025 at 1:37 AM
Shouldn’t it be, “Trump purports to unconstitutionally use federal pardon power on ally’s state conviction…” or something like that?

Em dashes are such a fixture or legal writing, I have simply decided not to worry about people thinking they might be AI generated in my writing.

This was the first course in my undergrad honors curriculum; it had a huge impact on me as a lawyer!

There’s a lot of article 3 law about the nature of judicial power, though.

Tried to explain to my non-lawyer partner why this is so devastating, and I don’t think it really stuck.

I think Judge Thapar is talking here more about the level of generality or certainty at which officers have to know the law in order to avoid civil liability, rather than whether they have to know it at all.

Hmm idk, the metaphysical (not sure how you define/delimit) could absolutely include or drive someone to do something worthy of censure. I would draw the line at criticizing belief alone, rather than criticizing action.
November 24, 2025 at 12:45 PM
Yeah, I don’t think we disagree, then! The idea that no one can criticize what for one person is religious observance/exercise is extremely corrosive, which is why I wouldn’t draw the line at whether the activity addresses the metaphysical or not.

I think i actually have no problem with protesting places of worship in the abstract, but I reject the idea that outsiders get to determine the limits of Jewish religious observance.
November 24, 2025 at 3:14 AM
You don’t think Jewish communities should get to decide for themselves what the sanctity of religious communal activity is about?
November 24, 2025 at 3:06 AM
Steve, it’s not totally unheard of to issue an opinion while a dissent is still being written, is it? SCOTUS did it this spring, no?
