In the report, I think Kaste put some effort into explaining the lag between the adoption of the 14th amendment and the time the U.S. government recognized the principle of birthright citizenship.

The point I’m trying to make is that the rights guaranteed in the text of the Constitution aren’t always immediately recognized. It often takes time, new circumstances and court cases to recognize new rights. That’s why there is a gap between the adoption of the law and recognition of the right.

So was I. Martin Kaste is the NPR Reporter who filed this report. The written article is a transcript of most of the report. Pay attention to how he describes the derivation of the principle of birthright citizenship from the text of the 14th amendment, but it took a few years and court cases 1/2
