I agree! Regards ascertaining a GRC, what many trans people have pointed out to me is this: don't! Cis women can't produce one and can't prove a negative if challenged "by mistake". A GRC updates birth certificate and HMRC records, so the approach can and should be the same for cis and trans people.

This is a close implementation of the drafting instruction's two "temporary exceptions". In statute. And it is very telling that the "preserving decency and privacy" exception for sharing facilities in particular did not apply once transition was complete.

Now if others could object to the use of birth sex facilities while undergoing reassignment, clearly that objection remains once reassignment is complete. Therefore, the intended effect is to use the accommodation and facilities of the *reassigned* sex. It is right there in the statutory instrument!

Section 4 of the 1999 regs, 7B (3) ensures the exemptions in (2) are temporary, it does not list "has undergone". So 2c "sharing accommodation and
facilities with either sex whilst undergoing gender reassignment" - a trans person who *has undergone* reassignment is not subject to this...
