I lived through all these events as a college student. It is hard to explain the 60s and 70s to someone born after 1980. But the current moment comes close. You got a sense back then that anything could happen, even the unimaginable, and it usually did. But even Nixon was not Trump; he had limits.

The commerce clause argument will appeal to the so-called conservatives on the Eighth Circuit and the Supreme Court. The Supreme Court is always looking for ways to corral Congress, and this may be one of them. It is an easier argument to understand, but not as sexy as the First Amendment.

Originalism was always intended as a policy choice, as it predetermined that conservative policies would be applied. And when the historical record did not favor conservative policies, the Supreme Court would apply it dishonestly to reach the desired result.

Of course, you assume originalism will be honestly applied in this case, which is not an assumption I would make. The Supreme Court and other courts have been known to misuse history.

I have practiced in federal court for over 40 years. This attorney's case load is beyond absurd. You are overworked if you handle 10 to 20 federal cases. Federal court work is dominated by paper--status conference reports, pretrial conference statements, discovery motions, etc.

Two things will bring down ICE, Noem and Trump: outrage and absurdity. Kidnapping 5-year-olds and killing mothers produces outrage; investigating the dead gives us absurdity. We are back to the era of Charles II, when the king demanded a corpse trial of Cromwell.

You need to pay attention to Trump's crazier statements, because they have an unfortunate habit of becoming policy. There is no Trump Derangement syndrome, because even the most crazed mind cannot imagine what Trump thinks.

No oil company will invest in Venezuela when it can expect military protection until Jan. 20, 2029. Then, a new administration will withdraw any US troops. Not to mention the oil is sludge and expensive to refine. Besides, Trump screws up everything else that demands planning. This will be the same.

Why oil companies are reluctant to go into Venezuela: Any oil exploration company realizes it takes years to repair old pipelines and drill new wells. And they will demand military protection. But what can Trump realistically promise? Military protection until Jan. 20, 2029. After that, nothing.
