It's poor wording, most of the work in enrichment goes into that first 50-60% (considering natural uranium is 0.72% U-235). Making the jump from 60% to 90% is far, far easier.

Once we move on from this era of the Supreme Court, I think we're going to see this line of thinking, if not this exact footnote, be part of the basis of a lot of overturning decisions.

In order to completely eliminate Iran's nuclear enrichment capabilities, Israel would need our bunker-busting bombs. Even if we sold them to the Israelis, I don't think they have a plane capable of carrying them.
