Harry,

We see ICE assault people for exercising their First Amendment rights, or just people they arrest, routinely.

Why don't they sue?!

Republican SCOTUS "Justices" ended Bivens suits? At least put them on record every time that they have ended enforcement of the Constitution -- for their opp

Your 89 year old grandma who bakes cookies for the orphanage is a domestic terrorist because she voted against Trump and marched with her walker in the No Kings protest. ICE may have no choice but to gun her down.

Rachel, in your recent interview Jon Ralston talks about how Harry Reid tried to get his show canceled, and you laughed about it, a terrible violation of the first amendment. You should’ve taken it very seriously. We lose credibility when we don’t condemn this just as strongly for our side.

Ryan, general comment: Can we at least try to sue! At least put the Republican Supreme Court Justices on record allowing Trump's henchmen to violate Constitutional rights with impunity, including murder, because they disallow Biven's lawsuits, that they allow Trump to accept bribes for pardons,...

Just learned that you cannot sue the federal government for violating your Constitutional rights, as Republican Supreme Court judges have forbidden "Bivens" lawsuits. It is so bad that we literally need an amendment now saying the Constitution must be enforced so it's not useless ink
January 15, 2026 at 6:00 AM
All of the innocent people assaulted by ICE, where are the lawsuits? Of course, no "limited immunity" should supersede the First and other amendments. All of the corp.s, organizations, and individuals threatened or punished with the power of government for exercising speech, where are the lawsuits?

I should add that this is complicated. We have to work with regimes like in China and Russia, and rules can help, but there is no moral legal right for an autocracy to subjugate and mass murder a people. If we can free a people without the cost being too great all things considered, this is good.

JVL,

A crucial point is that no dictator ever has legitimacy, and ever has any right to subjugate and kill his people. Any law which says this is an immoral law and should be disregarded. We can’t save every subjugated people, but it is right if we do and give them democracy, but Trump never will

JVL, I’m going to put this here because it is extremely important. We should never forget that Trump would never have expanded this kind of political capital to keep the Epstein files hidden if there weren’t something(s) in there incredibly bad for him or key allies.

Ryan, this regime breaks the law constantly. What we most need to know from you is what can we do about it?! Are we to constantly only hear day after day about how they act above the law, or are we ever going to be able to hear if and how the law can be enforced, or how we can at least try?

Crucial to add that our nominees to the Supreme Court cannot be Merrick Garlands. In general, you cannot have people who, when the Republicans use brass knuckles, they refuse to do the same, no matter what. This puts democracy in grave danger. Quickly overturn all the lawless Republican rulings.
December 6, 2025 at 10:24 AM
JVL, the key is SCOTUS. If the forces of democracy and the rule of law can retake a majority on the Supreme Court, then suddenly the constitution and all laws are now enforced again in a more or less unbiased way. This makes corruption the exception rather than the rule again.

JVL, I would not completely rule out the possibility of them employing the 25th amendment. If Trump is severely disabled with a stroke, he’s still not leaving, and at that point, they may think they have no better choice, and would pay no significant price. We should prepare for these things.
November 27, 2025 at 3:06 PM
JVL, great new bulwark article, but we also really need an article on what we should do, the strategy and tactics, if Trump dies, has a major stroke, advanced dementia, etc. in the next two years. It is not responsible to not prepare for this, and then strategize in a frantic rush at the last minute

JVL, we do produce more oil than we use, since 2020. However, the price of oil is based on global supply and demand, so Saudi Arabia can push up the price by restricting OPEC supply. But, oil is much less important today, and it would be a good incentive to ramp up alternative energy.

Greg, to people who say I don’t know if Trump did anything wrong, you are ignoring logic. There is no remotely plausible reason why Trump would incur this kind of massive political cost to keep anyone from seeing those files if there weren’t something incredibly harmful in there to him or his allies
November 17, 2025 at 8:11 PM
Greg, it’s important to keep in mind that whatever is in those Epstein files, it must be incredibly bad for Trump and/or his allies for him to be expending such an enormous amount of political capital to keep anyone from seeing it, worse than Access Hollywood.
November 17, 2025 at 7:46 PM
JVL, whatever is in there, it must be incredibly bad for Trump for him to pay this kind of a political price to keep anyone from seeing it. Even after what's gotten out already, after Access Hollywood, and on and on, he's still paying this kind of price to keep anyone from seeing the rest, Wow!
November 15, 2025 at 4:42 PM
I mean, come on, it doesn’t have to achieve a policy goal to be incredibly valuable, if it helps you win elections! And especially with democracy in grave danger! continuing would’ve made it more likely we win the midterms in the House and Senate, and that we save democracy!
November 13, 2025 at 6:11 AM
JVL, with regard to the shutdown what you and Tim and Sarah are missing is that it was hurting the popularity and image of Trump and the Republicans, and if it would’ve kept going, it would’ve hurt them a lot more, making democracy much more likely to survive. That is, of course, why you continue!
November 13, 2025 at 6:08 AM
JVL, your opinion on Tim Miller’s podcast that we cannot get back to where we were, I think, is wrong. If the Democrats win the presidency and the Senate, then we can take back the Supreme Court, and suddenly the constitution is enforced again, and that would profoundly change things-virtuous cycle.
