National Guard called up under federal authority are covered by the Uniform Code of Military Justice including the duty to NOT carry out clearly unlawful orders. Shooting peaceful protesters in the United States would presumably be unlawful, as would be officers ordering them to do so.

This order by Judge Wilkinson in the Fourth Circuit (a highly respected Reagan appointment) struck my as extraordinary. An Orwellian warning of where we are heading and a clear warning to Trump. Surprised it didn’t get more media attention.

I want to be the one to tell Trump that unlike his efforts to shut down funding and research to scientific, educational and medical institutions, he clearly has authority to effectively terminate SpaceX’s participation in the moon and mars landing programs.

It’s finally happened: I agree with Musk and Trump. I agree with Musk that Trump’s Beautiful bill is an abomination, and I agree with Trump that Musk is only upset that portions of the bill will hurt his own financial interests. They were made for each other.

This will make a nice exhibit for the defense in all those cases where the Government is asserting that the removal of suspected TdA members from the US under the ALien Act is necessary because the TdA presents a dire national security threat.

Harvard was always going to have to go to court and get an injunction to prohibit Trump from using the threat of a cutoff of federal funding to secure concessions from Harvard. This letter simply provides Harvard with the evidence to show that the threat was simply politically motivated extortion.
