I expect DOJ will continue to stonewall the court and on his Monday visit Bukele will decide to release him as a matter of foreign policy as a gesture of goodwill. By this they will try to establish that there is no appeal in the law, the only appeal is to Trump.

Calling it now. During Bukele’s state visit, Trump will announce an “agreement” for the return of Abrego Garcia. Then DOJ will claim the case is moot. No judicial testing of the wild authoritarian claims in their daily update briefs, and they get to cite themselves in the other pending habeas cases.

Oof. Maybe if SCOTUS orders return of Abrego Garcia tomorrow, maybe then you can look at these cases together and say they represent a compromise that preserves some minimal due process while giving MAGA enough of a win to avert a full blown refusal to obey the Supreme Court. Maybe? Looking for hope
