What do we owe posterity? I teach public policy at Georgia Tech to those who are likely to live to the year 2100 or later. Many still believe in the possibility of progress – and not only technological progress.
The majority's arguments were largely hypotheticals about, e.g., Congress converting State into an independent unfireable commission. In Trump v. US, hypotheticals about a pre-immune'd president fomenting a coup were ignored. Any inconsistencies within this Court?

I wish I understood vacatur better! I'm not a lawyer, but it's confusing whether the original District Court's decisions had significant factual errors, had followed improper procedures, or ignored newly discovered evidence. It looks like Energy Transfer might have had all three types of mistakes.
