When I had a case in Austin, I stood. But my mentor as a Mass. lawyer had a story about standing to argue in Texas, and he heard the judge to drawl “this is a ceded jurisdiction.” Which confused him until local council grabbed him by the arm and hissed “sit down!” (Ceded was really “seated”)

There was a Mass. case where the jurors wore Halloween costumes. They asked permission from the judge who got the consent of all counsel and then allowed it. Appeals court chastised the trial judge but held the issue waived as an appellate issue due to counsels consent law.justia.com/cases/massac...

Not likely. Lack of candor to tribunal under Rule of Professional Conduct 3.3 typically suspension or reprimand. There’s also Rule 3.8 (special responsibilities of a prosecutor) but that’s also unlikely to lead to disbarment

My random prof responsibility question is if prosecution of Comey flops, should Halligan fear for her bar card? At least here in Mass. no lawyer has ever been disciplined for violating Rule Prof C 3.8(a) (prosecutor can only bring case supported by probable cause).

Rule of Professional Conduct 3.8(a) varies a little by state but basically says a prosecutor may not bring a case absent probable cause. There are no reported disciplinary cases under it here in MA. Interesting to see if new law gets made!

This is absurdly stupid. Though I will say I sometimes have to stay in boring business hotels for work and need to make cocktails in field conditions. I bring some whiskey nips, and I have these sugar cubes pre-soaked in bitters, from which I can make an acceptable old fashioned

I once successfully appealed a parking ticket in Brookline on a defense of inadequate signage. I cited Federal Highway Administration signage standards. It remains my greatest achievement in 20 years at the bar
