The fact that they shifted operational command from a regular CCMD (SOUTHCOM) to SOCOM is another tell; they needed folks who were willing to, um, 'color outside the lines.'

Not a lawyer... but think this is where/how they (SCOTUS 6) reverse engineer their opinion... i.e., if you are here illegally then you are NOT "subject to the jurisdiction thereof." Ugly stuff.
