imho - the letter of the law of KSR does not apply to design patents but the CAFC will find either (i) the spirit of KSR does (no rigid tests) or (ii) the Durling/Rosen test is not rigid, it’s being read too narrowly, or (iii) both. Cc @design-law.bsky.social
