This maneuver also clashes with the Militia Clause in the U.S. Constitution (Article I, Section 8, Clause 15), which gives Congress, not the president, the power to call forth the militia under specific conditions like insurrection or invasion.

The man who led insurrectionists to ransack the capital building on Jan 6th is literally equating a largely peaceful protest with an active rebellion against the United States—as justification to bypass Government Newsom and directly mobilize the armed forces against their own fellow Americans.
