I read Stout’s anti-Dodge article so I don’t find these citation findings surprising. But I also teach in B-school and study econ. I’m totally convinced that Dodge v. Ford reflects a lot (even if might not explain it). Even if we stop teaching it, they won’t stop believing and teaching it’s ethos.

For the record, this is just proof of property’s power. The contract exists to serve and protect property… as does most of criminal law. 😉

There are a LOT of undefined terms here, so I’m going to go on a limb with *they* don’t. What even is the LPE movement? (Not agreed) Who exactly are its leaders? (Not agreed) And what are they doing (or not) that harms credibility or good will. Genuinely wondering.

Not sure I think a syllabus for a class like property is likely to tell you anything. Happy to discuss my own approach, but a review of popular casebooks is probably instructive as to the dominant approaches.
