Rule 81(4)(b) is actually one of the most inscrutable texts I can recall seeing. The civil rules apply in habeas cases to the extent that the practices are similar? Not much help when the whole question is whether the practices are similar.

Also, I’m not sure what Rule 81 looked like in 1970, when the article Alito is citing was published, but the modern version of Rule 81 does not, to put it mildly, seem to obviously bar Rule 23’s application in habeas cases.

What if you don’t think they’ve been functioning well, but think that it’s important that they function well because institutions are good, and think that other institutions have been functioning well (e.g., much of the executive branch, NATO)?
