But again, as I've been saying these are simply more abuse tactics. We must remember. Cassie is not on trial. Her past is not on trial. Diddy is on trial. Diddy is accused of trafficking rape, physical abuse, surveillance, and more.

The defense is trying to distract the jury by slutshaming.

Even with these exceptions the defense would have had to file motions and go through hearings. they cant just blurt things out.

The exceptions to this are narrow.
- if someone else might be responsible for the physical evidence
- if the past behaviour is directly with the accused and relevant to proving consent
- if excluding it would violate the accused's constitutional rights.

The rule exists to stop exactly what Diddys defense is trying to do : attempts to undermine a victims credibility or imply consent by dragging their sexual history into court. You can't just say "she had a past" and expect that to justify abuse.

You cannot consent to swinging (or any kind of non monogmay) if you:
- Don’t understand what it is
- Are high
- Are being threatened
- Are afraid of what will happen if you say no
That’s not consent. That’s coercion.

And for those unfamiliar swinging is a form of non-monogamy where people (often couples) engage in sexual activities with others, either together or separately. It requires clear communication, mutual agreement, and enthusiastic consent from all parties involved.

- & sober
