* Immediate corrective action by MDH to ensure no one is disenrolled without due process, accurate address notifications and timely appeals.

* The lawsuit seeks to represent all ~18,000 Medicaid waiver participants in Maryland.

This is personal and critical for Marylanders with disabilities: eligibility missteps threaten independent living, employment support, behavioral services, day programs and even residential placements.-

* Hundreds investigated so far: The department admitted it restored coverage for 263 people who were mistakenly removed—but the full number remains unknown.

* At least 30 people supported by The Arc were wrongly disenrolled even though they were still eligible.

* Some notices were not sent in the participant’s chosen language. As an example, some notices were sent out in English where the participant’s chosen language was Spanish.

* Some notices were sent to wrong addresses (including ones the provider hasn’t used for over five years). The Eligibility Redetermination Division (EDD) within the department, sometimes fails to acknowledge receipt of paperwork and ignores calls/emails.-

* Since the restart of redeterminations in May 2023, many people with IDD have been disenrolled without notice, without a meaningful hearing, and often without any valid reason—even though they remain financially eligible.

* The case cites that the redetermination process for the Medicaid waiver programs (including Community Pathways, Community Supports and Family Supports) is so “opaque, dysfunctional and arbitrary” that even long-standing providers cannot navigate it.
