Thanks, it's further refinement of that situation, that not all German minorities spoke German and got spared of this double madness of conscription and evacuation plus following deportation.

Thus, membership in an organization like the SS became sufficient cause for arrest. But Law No. 10 did not require that all persons considered as criminals be prosecuted; it simply gave the commanders of the occupation forces authority to bring charges as warranted .

Well, prosecute him, go on, I won't stand in your way for sure.
Just saying that after WW2 whole nations were labeled collectively guilty or regions were deported due to their language etc, it wasn't the era of law as you know it, so fleeing not necessarily proves guilt.
