Another example of what @qjurecic.bsky.social flagged, the poor drafting of these EOs. In this case the EO doesn't define what it means to be engaged in a migrant "invasion," seemingly opening the door to treat any/all undocumented migrants as invaders who don't have any asylum rights under INA.
Trump's executive order declares that because migration is an "invasion," his authority to combat it is wholly rooted in the Constitution. Legal experts say this in effect declares he's not bounded by congressional statutes like the Immigration and Nationality Act:
